CoDriver Terms of Service
Effective date: October 9, 2026 · Version 2.1
CoDriver is operated by Navid Ehsani Azad in British Columbia, Canada ("CoDriver", "we", "us"). These Terms of Service (the "Terms") govern your use of the CoDriver iOS application and the services behind it (together, the "Service"). You accept these Terms in the app by reading them and ticking the box marked "I have read and agree". If you do not agree, do not use the Service.
You must be at least 18 years of age and accepting on your own behalf to use the Service.
Our Privacy Policy at https://trycodriver.com/privacy explains how we handle personal information and forms part of these Terms.
1. Definitions
- "App" means the CoDriver iOS application, including its CarPlay interface, Live Activity, and every update.
- "Service" means the App together with the control, voice, and relay infrastructure we operate.
- "CoDriver Marks" means the name "CoDriver" and the logos, icons, and other branding associated with the Service.
- "User Content" means content you create or transmit using the Service, including voice audio, GPS positions, drive history, routes and destinations you set, and the drives and routes you share with others.
- "Feedback" means suggestions, ideas, bug reports, feature requests, or other input you give us about the Service, in any form.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing. No licence to the CoDriver Marks is granted.
You will not: (a) copy, distribute, sell, rent, or sublicense the App; (b) reverse engineer, decompile, or attempt to extract source code from the App, except to the extent applicable law permits this notwithstanding this limitation; (c) probe, scan, or test the security of the Service without our prior written permission; (d) access the Service by any means other than the App; (e) share your account credentials or let another person use your account; or (f) use automated means to create accounts or to send requests to the Service.
3. Your Account
You need an account to use the Service. You must give a valid email address, keep your password confidential, and tell us promptly at [email protected] if you believe your account has been compromised. You are responsible for everything done through your account. You may delete your account at any time in the App (Profile → Delete account); deletion is immediate and permanent, as described in the Privacy Policy.
4. Safety and Acceptable Use (Read Carefully)
CoDriver is a communication and coordination tool. It is not a safety device, a navigation authority, or an emergency service.
- Never operate the phone while driving. Do not look at, touch, or otherwise interact with the App on your phone while your vehicle is in motion. Set up your route, convoy, and audio before you move, or have a passenger operate the App.
- CarPlay. The CarPlay interface is designed for in-vehicle use, but no interface makes interaction while driving safe. Keep any en-route interaction to brief glances, the way you would treat any car display, and comply with the laws on in-car screens where you drive.
- You are solely responsible for the safe operation of your vehicle and for compliance with all laws that apply to you, including distracted-driving, mobile-device, and traffic laws, and for holding a valid driver's licence and legally required insurance.
- Route, location, and convoy information may be inaccurate, delayed, or unavailable at any time. Voice connections may drop without warning. Do not rely on the Service for navigation decisions or for emergency communication.
- You will not use the Service in connection with racing, speed contests, or any unlawful or competitive driving on public roads.
- You will not use the Service to harass, threaten, demean, or impersonate any person, or to transmit unlawful, hateful, or otherwise objectionable content. You can block any user (a blocked user cannot reach you and you will not see each other) and report any user from within the App. We review reports and may remove content, suspend, or terminate any account at our discretion under Section 11.
- You will not use the Service's location, presence, or drive-sharing features to stalk, harass, follow, or monitor any person. You choose whom to accept as a friend and whether to share your location; anything you choose to share with friends is visible to all of your accepted friends, and we are not responsible for another user's use of information you chose to share with them. Location sharing is not a safety feature and must not be relied on as one.
- You will not disclose, publish, or misuse personal information about other users that you encounter through the Service, including their locations, routes, and drives.
Audio consent. By joining a convoy you consent to your voice being transmitted to and heard by the other members in real time. CoDriver uses an open microphone while you are unmuted in a convoy; there is no push-to-talk. A speech detector on your device transmits what it judges to be speech and suppresses the rest, but it cannot tell whose speech it is: passengers and other voices your device picks up are transmitted until you mute. You are responsible for ensuring that anyone whose voice may be captured by your device is aware of, and consents to, that transmission. You will not use the Service to transmit any person's voice without their consent.
Assumption of risk. Using the Service involves operating real vehicles on real roads. To the maximum extent permitted by law, you voluntarily assume all risks arising from your driving and your use of the Service, including the risk of accident, injury, death, and property damage.
5. User Content and Feedback
You retain ownership of your User Content. You grant us a worldwide, royalty-free licence to host, transmit, process, and display User Content solely as necessary to operate and improve the Service and to deliver it to the people you choose to share it with. You represent that you have the rights needed to grant this licence and that your User Content does not violate the law or the rights of any person.
The Service, the CoDriver Marks, and all related intellectual property remain our property. No rights are transferred to you except the licence in Section 2.
Feedback. You assign to us all right, title, and interest in Feedback, including all intellectual property rights in it, effective as each item is created or provided. Where such assignment is not permitted by law, you instead grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable licence to use, modify, and commercialise Feedback for any purpose. You waive all moral rights in Feedback and, where waiver is not permitted, agree not to assert them. Feedback is not confidential, we owe you no compensation or credit for it, and we may already be developing or may independently develop similar features.
6. Third-Party Services
The Service uses Apple Maps for search and directions, Apple push notifications, and your device's system music player to show what is playing. Your use of those services is governed by Apple's terms and privacy policy. Using the Service requires a wireless data connection; you are responsible for complying with your carrier's agreement and for any data charges. You agree to comply with all applicable third-party terms when using the Service.
7. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that routes, positions, estimated times, or voice connections are accurate, timely, or available. Nothing in these Terms excludes warranties, guarantees, or rights that applicable law does not permit to be excluded; where such laws apply, our liability is limited to the minimum extent permitted.
8. Limitation of Liability
To the maximum extent permitted by applicable law: (a) we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising out of or relating to these Terms or the Service, however caused; and (b) our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim and CAD $100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud, for gross negligence or wilful misconduct, or for death or personal injury caused by our negligence where such exclusion is not permitted.
9. Indemnification
You will indemnify and hold us harmless from all claims, damages, and reasonable legal costs arising from: (a) your operation of a vehicle; (b) your violation of law, including traffic and recording-consent laws; (c) your transmission of any person's voice or data without consent; (d) your User Content; or (e) your breach of these Terms.
10. Changes to the Service and to These Terms
We may modify, suspend, or discontinue any part of the Service at any time. We have no obligation to maintain any feature or to carry your data forward across versions, except as the Privacy Policy states.
We may update these Terms. Any change to their text creates a new version with a new effective date, published at https://trycodriver.com/terms. The App will show you the new version and ask you to accept it before you continue using the Service; if you do not accept, you may stop using the Service and delete your account.
11. Term and Termination
These Terms take effect when you accept them and continue until terminated. You may terminate at any time by deleting your account. We may suspend or terminate your access at any time if you breach these Terms, if required by law, or if we discontinue the Service; where practicable we will give you notice in the App or by email. On termination your licence ends. Sections 4 (assumption of risk), 5, 7, 8, 9, 12, 13, and 14 survive termination.
12. Apple-Specific Terms
This Section applies because the App is distributed through the Apple App Store.
- Acknowledgement. These Terms are between you and Navid Ehsani Azad only, not with Apple Inc. or its subsidiaries ("Apple"). We, not Apple, are solely responsible for the App and its content. These Terms do not grant you rights to use the App that are less than, or that conflict with, Apple's Media Services Terms and Conditions.
- Scope of licence. The licence in Section 2 is limited to a non-transferable licence to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, with the Family Sharing and volume-purchasing exception stated in Section 2.
- Maintenance and support. We are solely responsible for providing any maintenance and support for the App, as specified in these Terms or as required by law. Apple has no obligation to furnish any maintenance or support for the App.
- Warranty. We are solely responsible for any product warranties, express or implied by law, to the extent not disclaimed in Section 7. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the App to you, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are our responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including (i) product liability claims, (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property claims. If a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of the claim.
- Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Questions, complaints, or claims about the App may be directed to Navid Ehsani Azad, British Columbia, Canada, at [email protected].
- Third-party terms. You must comply with applicable third-party terms when using the App, including your wireless data service agreement.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. On your acceptance of these Terms, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
13. Governing Law and Disputes
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in it, and disputes will be resolved in the courts of British Columbia; provided that, if you reside in a jurisdiction whose laws grant you mandatory consumer protections or the right to bring proceedings in your home courts, those rights are unaffected.
14. General
- Severability. If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder continues in effect.
- Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us concerning the Service and supersede all prior agreements, including any beta test agreement.
- Assignment. We may assign these Terms, including to a company we incorporate. You may not assign them.
- No waiver; relationship. Failure to enforce a provision is not a waiver of it. Nothing in these Terms creates a partnership, employment, or agency relationship.
- Electronic contracting. You consent to entering into these Terms electronically. Ticking the box marked "I have read and agree" and continuing is your electronic signature. We record your acceptance as described in the Privacy Policy (account identifier and handle, terms version, hash of the text shown, app build, and time), and that record satisfies any requirement that these Terms be in writing and signed.
- Export. You will not export or re-export the App except as authorised by Canadian and United States law.
- Language. These Terms are drafted in English; any translation is for convenience only.
- Notices. We deliver legal notices in the App or to the email address on your account. You may contact us at [email protected].
